Terms of Use

Effective date: September 14, 2026

PrivacyTermsSupportContact

These Terms of Use govern the HummingLab mobile application, website, subscription services, and related content provided by HummingLab LLC.

Agreement to these terms

By downloading, accessing, or using HummingLab, you agree to these terms. If you do not agree, do not use the app or website. If you use HummingLab on behalf of an organization, you represent that you have authority to bind that organization.

Eligibility

HummingLab is not intended for children under 13. You must be at least 13 to use HummingLab. If you are under the age of legal majority where you live, you may use HummingLab and purchase a subscription only with the permission and supervision of a parent or legal guardian. The parent or guardian is responsible for the minor’s use of HummingLab and any subscription purchases made through their app-store account.

General-wellness service

HummingLab is a general-wellness and educational product. It is not a medical device, healthcare service, diagnostic tool, or treatment, and it is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

HummingLab’s frequency guidance, voice measurements, session feedback, educational material, and references to scientific research are not medical advice and are not a substitute for evaluation or care from a qualified healthcare professional. Individual experiences vary, and no health outcome is promised or guaranteed.

Safe and appropriate use

Use HummingLab only when it is safe to focus on a vocal exercise. Do not use it while driving or operating machinery. Use a comfortable volume and effort. Stop immediately if you experience pain, dizziness, shortness of breath, distress, vocal strain, or other discomfort. Seek medical care when appropriate, and call emergency services if you believe you may have an emergency.

Microphone and local profiles

Pitch-feedback features require microphone permission. Current versions process microphone audio and store profiles locally as described in our Privacy Policy. You are responsible for choosing profile names that you are authorized to use, especially on a shared device.

License and acceptable use

Subject to these terms, HummingLab LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful, noncommercial purposes. You may not misuse the services, interfere with their operation, bypass access or safety controls, attempt unauthorized access, distribute malicious code, or copy, modify, sell, or reverse engineer protected portions except where applicable law expressly permits it.

Intellectual property

HummingLab’s software, interface, content, databases, branding, and related materials are owned by HummingLab LLC or its licensors and are protected by applicable intellectual-property laws. Certain HummingLab mechanisms are patent pending. No ownership rights are transferred to you.

App stores and devices

Your use of the app may also be governed by the rules and standard license terms of Apple App Store or Google Play. Apple and Google are not responsible for HummingLab’s content, support, or claims except to the extent their applicable terms state otherwise. You are responsible for a compatible device, operating system, and any carrier or internet charges.

Subscriptions and purchases

HummingLab Premium may be offered through monthly and annual auto-renewing subscriptions. An active subscription provides access to the Premium features described in the app at the time of purchase.

Before you confirm a purchase, Google Play will display the applicable subscription plan, billing period, localized price and currency, applicable taxes, and any trial or promotional terms. Please review that information carefully before completing your purchase.

Payment is charged to your Google Play account when the purchase is confirmed. Unless canceled, an auto-renewing subscription renews automatically at the end of each billing period, and Google Play may charge your payment method for the next billing period at the price shown for your subscription.

You can manage or cancel your subscription through Menu → HummingLab Premium → Manage Subscription in the app or through the Google Play Subscription Center.

Deleting HummingLab, deleting a voice profile, clearing local app data, or stopping use of the app does not cancel a subscription.

Cancellation generally takes effect at the end of the current paid billing period, and Premium access generally remains available until that period ends. Different cancellation or prorated-refund rights may apply depending on your location, applicable law, and Google Play policies.

Refund requests and refund eligibility are handled according to Google Play policies and applicable law. HummingLab does not independently control every Google Play billing or refund decision.

If you change from one subscription plan to another, Google Play will display the effective date of the change and any immediate charge, credit, or prorated amount before you confirm it.

If payment cannot be completed, a subscription expires, or Google Play otherwise reports that the subscription is no longer active, access to Premium features may be suspended or terminated. You may use the Restore Purchases feature to ask Google Play and RevenueCat to verify a previous eligible purchase.

RevenueCat provides HummingLab’s subscription-verification and Premium-access infrastructure but does not process your payment method. Subscription-related information is handled as described in our Privacy Policy.

We may change subscription features or prices in the future. Price changes affecting existing subscribers will be handled with the notices and consent procedures required by Google Play and applicable law.

Updates and availability

We may improve, update, suspend, or discontinue features or content. We do not guarantee that every feature will remain available or operate on every device. The app may require updates to continue functioning properly.

Feedback and support

If you send suggestions, you allow us to use them without restriction or compensation, but you retain ownership of any rights you already hold. Product support is available through our Support page.

Disclaimers

To the maximum extent permitted by law, HummingLab is provided “as is” and “as available.” HummingLab LLC disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the maximum extent permitted by law, HummingLab LLC and its members, officers, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use, arising from or related to HummingLab. Nothing in these terms excludes liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Mandatory consumer protections in your place of residence remain unaffected.

Changes to these terms

We may update these terms as the product or applicable requirements change. The revised version will be posted here with a new effective date. Continued use after an update means you accept the revised terms to the extent permitted by law.
